Gerry Island issues comes back again

Peter Noyes has appealed the Marblehead Conservation Commission’s denial of his plan to use the island for commercial purposes. In his filing, Mr. Noyes called the ConCom’s decision, “arbitrary and capricious,” according to the Marblehead Reporter. Noyes has asked for permission to develop the island, use the semi-tidal causeway for transport and access, and was denied due to the possible effects on the coastal wetlands. The appeal of the enforcement orders (EO) triggers a 20-day period in which the Town of Marblehead must respond. So, the battle of development versus the interests of protecting nature’s majesty again descends into the courts in the hands of lawyers. More to come… of course.
